ΑLL YOU SHOULD KNOW
ABOUT THE LEGAL FRAMEWORK OF THE ART
Greece is the ultimate «fertility destination» in terms of both legislation and scientific expertise. That is why it is considered as one of the most friendly countries for couples facing fertility problems.
In the table below you will see exactly what is applicable in Greece concerning the Medically Assisted Reproduction (IYA):
Age limits: The 54th year of age for the woman on the day of the embryo transfer. There is no age limit for men.
Egg donation: It is allowed to any woman who is unable to have a child with her own eggs, for whatever reason. The condition is her age not to exceed 54 years on the day of the embryo transfer.
Sperm donation: It is allowed to every man who is unable to have a child with his own sperm, for any reason. Unlike the woman, for the man, there is no age limit as this is the only way to have a baby.
Sperm donation is also allowed for single women who want to have a child.
Embryo donation: The legislation remains the same as that of egg donation for women and sperm donation for men.
Selection of donors: The selection of the donor is applied according to the phenotype of the person who asks for the donation. For those women who do not have a partner, they can choose the phenotype they prefer, as they would for their partner.
Sex selection: Allowed exclusively to avoid inherited, sexually transmitted diseases, is prohibited for any other reason, including family balance cases..
Certification of the relationship between couples who choose some method of ART: In addition to married people with religious or civil marriage who must provide a copy of the official certificate, couples who come to a clinic to undergo ART, must provide an official copy of a notarial document that will validate their relationship, giving them the right to be considered the parents of the child to be born.
Women without a partner: Women without a partner who want to become mothers should submit a notarial document stating that they wish to have a child thanks to ART methods with sperm donation.
Cold storage and storage of sperm, eggs, and embryos: It is allowed by law for up to 10 years. In case that a couple, a woman, or a man wishes to extend this period, a special permit from the National Authority of ART is required.
1. If a couple does not want to use their embryos, they have the following options:
2. to demand their destruction
3. to donate them to another couple/woman candidates for ART
4. to offer them for research purposes
The above three options apply to the case of eggs, sperm, or embryos from the woman, the man, or the couple from which they come.
Anonymity: The donation of eggs and sperm is mutually anonymous, both for those who donate them and for those who receive the donation. The same applies to the child who comes from a donation. They may not have access to the data of the donor from whom it originated and the donors may not have access to the data of the child born thanks to them.
The number of children from each donor: No more than 6 children. Once this number is completed, the donor’s eggs/sperm ceases to be available and is destroyed.
Surrogacy: It is a legal process from the moment of publication of the court decision that allows a woman or a couple to conceive through a surrogate mother. This method can be used strictly by women who, for serious medical reasons, cannot conceive. At the same time, the surrogate mother must be certified to be healthy after special tests and can carry out the pregnancy. In addition, the embryos transferred to the surrogate mother, must not come from the eggs of the surrogate mother and the sperm used for the IVF to be either from the biological parent or from an unknown donor.
It is worth mentioning about the above most important parameters of the Greek Legislation regarding IYA, that they are guaranteed by every officially certified and licensed assisted reproduction clinic.

It has also a license for offering donated eggs, sperm, and embryos for its ART services.
